OFFICIAL RULES

NO PAYMENT OR PURCHASE NECESSARY TO ENTER OR WIN. YOUR CHANCES OF WINNING DO NOT INCREASE WITH A PURCHASE. VOID WHERE PROHIBITED. THIS SWEEPSTAKES IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH TIKTOK, INSTAGRAM, YOUTUBE, FACEBOOK OR ANY OTHER SOCIAL MEDIA PLATFORM. These Official Rules are hereby incorporated into the Homeboost Terms of Service. 

1. Eligibility. The Homeboost Sweepstakes is open only to consumers that (i) own a single-family dwelling or similar residence (“Residence”), (ii) own or rents a BoostBox, and completes their home scan (ii) are legal residents of the fifty (50) United States or the District of Columbia, and (iiii) who are eighteen (18) or older at the time of entry. Employees of Homeboost, Inc., as well as the immediate family (spouse, parents, siblings and children) and household members (whether or not related) of each such employee are not eligible. The Sweepstakes is subject to all applicable federal, state and local laws and regulations and is void where prohibited by law.  
2. Sponsor. HomeBoost Inc. (“We”, “Us”, “Sponsor”, “Homeboost”), 1005 Northgate Drive #211, San Rafael, CA, 94903; or by e-mail to info@homeboost.com.  
3. Agreement to Official Rules. Participation in the Sweepstakes constitutes your full and unconditional agreement to these Official Rules and the decisions of Sponsor, which are final and binding. 
4. Entry Period. The Sweepstakes begins on March 1, 2025 at 12:00pm Pacific Time and ends on April 30, 2025 at 12:00pm Pacific Time (the “Entry Period”).   
5. Entry. To enter, during the Entry Period, (i) conduct an Energy Home Assessment on your Residence using your BoostBox (“Assessment”), and (ii) share with Homeboost a copy of your Assessment. Limit: one (1) entry per person or email address. Subsequent entries will be void. Entries become the property of Sponsor and will not be acknowledged or returned. The use of bots or other automated methods of entry is prohibited. 
6. Selection of Potential Winners. On or about May 1, 2025, Sponsor or its agent will select 1 potential winner at random from among all eligible entries received. Potential winner will be notified by email. If the potential winner cannot be contacted within five (5) days of the first attempt to contact them, the entrant with the next highest score will be the potential winner. The odds of winning depend on the number of eligible entries received.
7. Requirements of Potential Winner. Except where prohibited, potential winner must complete and return an affidavit of eligibility and liability/publicity release (the “Affidavit/Release”) within ten (10) days of being notified. If a potential winner fails to sign and return the Affidavit/Release within the required time period, if notification or prize is returned as undeliverable, or if Sponsor determines in its sole discretion that the potential winner is ineligible, an alternate entrant will be selected in their place. Unless prohibited by law, acceptance of a prize constitutes permission for Sponsor to use winner’s name, picture, likeness, address (city and state) and biographical information for advertising and publicity purposes, worldwide, without further compensation.  
8. Prize. For one (1) winner, Homeboost will pay a contractor, who is selected by winner, and approved by Homeboost (“Contractor”), an amount of up to $4,999.00 to make home repairs or product upgrades recommended in the results of the Assessment (“Recommended Repairs”). At the winner’s request, Homeboost will assist winner in locating the Contractor who can make the Recommended Repairs, but it shall be the winner’s obligation and responsibility to contract with such Contractor. For the avoidance of doubt, winner and not Homeboost will be responsible for any Contractor claims, fees or costs that are (i) over $4,999.00, or (ii) unrelated to the Recommended Repairs. For the avoidance of doubt, if the costs of the Recommended Repairs are lower than $4,999.00, neither the winner nor Contractor will not receive any additional amounts.  The winner will not receive any payment or monies from Homeboost. All federal, state and local taxes are the responsibility solely of winner. Prize is non-transferable and non-assignable. No cash or other substitution permitted, except that Sponsor reserves the right to substitute a prize or prize component of comparable or greater value at Sponsor’s sole discretion. 
9. General Conditions. In the event that the operation, security or administration of the Sweepstakes is impaired in any way for any reason, Sponsor may, in its sole discretion, suspend, modify and/or cancel the Sweepstakes and, if feasible, select a potential winner(s) from among eligible, salvageable and non-suspect entries received on or before the termination date. Inclusion in such a drawing shall be each entrant’s sole and exclusive remedy under such circumstances. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the operation of the Sweepstakes or to be acting in violation of these Official Rules or in a disruptive manner. Any attempt by any person to undermine the operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. In the event of a dispute as to any online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. In the event that an entry is confirmed to have been erroneously deleted, lost or destroyed, entrant’s sole remedy shall be another entry into the Sweepstakes. If any provision of these Official Rules is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced. 
10. Release and Limitation of Liability. TIKTOK, INSTAGRAM, YOUTUBE, FACEBOOK OR ANY OTHER SOCIAL MEDIA PLATFORM By participating in the Sweepstakes, you agree to release and hold harmless Sponsor, Meta Platforms, Inc., their parent and related companies, and each such company’s respective officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action arising, directly or indirectly, in whole or in part, out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) claims arising from any breach or alleged breach by you of these Official Rules; (b) claims arising from unauthorized human intervention in the Sweepstakes; (c) claims arising from technical or printing errors; (d) claims arising from lost, late, postage-due, misdirected or undeliverable mail, email or other communications; (e) claims arising from errors in the administration of the Sweepstakes or the processing of entries; (f) claims arising from injury, death or damage to persons or property; (g) claims based on defamation or the rights of publicity or privacy; (h) claims arising out of Recommended Repairs or your Residence; or (i) claims arising out of your relationship or contract with a Contractor. You further agree that in any cause of action, the Released Parties’ liability will be limited to the actual out-of-pocket costs of entering and participating in the Sweepstakes, and in no event shall the Released Parties be liable for attorneys’ fees, legal fees or expenses of any kind. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU WAIVE ANY RIGHTS OR CLAIMS TO ANY DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY SO THE ABOVE MAY NOT APPLY TO ALL ENTRANTS. 

IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE ANY AND ALL RIGHTS UNDER SECTION 1542 OF THE CIVIL CODE OF THE STATE OF CALIFORNIA, WHICH PROVIDES AS FOLLOWS: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”

1. Disputes. Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of New York. All issues and questions concerning these Official Rules, your rights and obligations, or Sponsor’s rights and obligations shall be governed by the laws of the State of New York, without giving effect to any choice of law or conflict of law rules.

Privacy. Personal information received in connection with an entry will be treated in accordance with Sponsor’s privacy policy, available at Privacy Policy.
